THIRD KAGURA Pty Ltd ("THIRD KAGURA", "we", "us", or "our") respects your privacy. This Privacy Policy explains how we handle personal information collected through our Equipment Rental service at djaudio.au. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
01Scope of This Policy
This policy applies only to personal information collected through djaudio.au (our Equipment Rental service). THIRD KAGURA also operates separate services, each with its own privacy notice:
- Corporate website — thirdkagura.com — covered by a separate Privacy Policy.
- Other services — to be announced. Each will have its own notice when launched.
This policy does not apply to personal information of THIRD KAGURA's current or former employees.
02What Personal Information We Collect
2.1 Information You Provide
When you make a booking enquiry, place an order, or contact us, we may collect:
- Identity and contact information — name, email address, phone number;
- Delivery information — event venue address, access notes (stairs, lifts, parking);
- Event details — date and time, vibe (e.g., intimate, energetic), guest count, equipment needs (DJ set, mics, speakers, lighting), activities (dinner, dance, ceremony);
- Payment information — processed by our payment provider; we do not store full card numbers on our servers;
- Security bond information — pre-authorisation or held charge details;
- Identification documents (only where reasonably required for verification, e.g., bond-related disputes);
- Correspondence — emails, messages, and notes exchanged with us.
When we collect personal information, we take reasonable steps to make you aware of why we are collecting it, who we may share it with, and how to contact us — through this Policy and at the point of collection (e.g., our booking form).
2.2 Information Collected Automatically
- IP address, browser type, device information, operating system;
- Pages visited, time spent on pages, referring URLs;
- Cookies and similar tracking technologies (see §5).
03How We Use Your Information
We use personal information collected through djaudio.au to:
- Provide quotes, confirm bookings, and process payments;
- Coordinate delivery, setup, and collection of equipment;
- Handle security bond pre-authorisations and refunds;
- Communicate with you about your booking (confirmations, reminders, late-return notices);
- Respond to enquiries, complaints, and support requests;
- Improve our website, equipment range, and service quality;
- Comply with legal obligations (e.g., taxation records, dispute resolution);
- Detect and prevent fraud, unauthorised access, or misuse of the service.
We do not use your personal information for direct marketing of other THIRD KAGURA services without your separate consent.
04Disclosure of Personal Information
We may share personal information with:
- Payment processors (e.g., Stripe, bank merchant services) — to process payments and pre-authorisations;
- Delivery and logistics providers — where we contract third parties for delivery (currently delivered in-house but may include partners in future);
- Hosting and technology providers — including Cloudflare Pages and analytics services;
- Professional advisers — legal, accounting, insurance, where reasonably required;
- Government bodies or law enforcement — when required by law (e.g., court order, ATO records request, OAIC investigation);
- Successors — in the event of a merger, acquisition, or business restructure.
We do not sell personal information.
05Cookies and Analytics
We use cookies and similar technologies on djaudio.au to:
- Maintain session state (e.g., kit selections in your booking funnel);
- Remember preferences and form inputs across page loads;
- Analyse website usage to improve the booking experience.
You may disable cookies in your browser. Some features (particularly the kit-builder and booking flow) may not function properly without them. We do not use third-party advertising cookies on djaudio.au.
06International Transfers
THIRD KAGURA Pty Ltd is based in Sydney, Australia, and personal information is primarily stored in Australia. Some of our service providers (e.g., Cloudflare CDN, payment processors, analytics) may store or process data in jurisdictions outside Australia, including the United States, Singapore, or the European Union. In line with APP 8, we take reasonable steps to ensure overseas recipients handle your personal information in a manner consistent with the APPs, including by selecting providers with industry-standard data protection certifications (e.g., SOC 2, ISO 27001) and by entering into contractual data-handling commitments where appropriate.
07Security
In line with APP 11, we take reasonable technical and organisational steps to protect personal information from unauthorised access, alteration, disclosure, or loss. These include:
- Encryption in transit (HTTPS/TLS) for all data submitted via the website;
- Access controls limiting personal information to authorised THIRD KAGURA personnel;
- Use of reputable payment processors so we do not store full payment card numbers;
- Regular review of security practices.
No internet transmission or electronic storage is fully secure. We cannot guarantee absolute security but we will take reasonable steps to investigate and respond to any suspected breach. If we experience a data breach that is likely to result in serious harm to affected individuals, we will assess it and, where the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth) applies, notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable, in line with our obligations.
08Retention
We retain personal information only for as long as necessary for the purposes outlined in this policy, or as required by law. In particular:
- Booking and transaction records — retained for at least 7 years from the date of transaction, to meet Australian Taxation Office (ATO) record-keeping obligations under the Income Tax Assessment Act and related legislation;
- Enquiry-only contact (no booking made) — typically retained for up to 24 months, then deleted or anonymised;
- Identification documents collected for bond disputes — deleted or anonymised within 12 months of dispute resolution unless retention is required by law;
- Marketing consent records — retained until consent is withdrawn, then deleted.
When retention periods expire, we delete or de-identify personal information in accordance with APP 11.2.
09Your Rights
Under the Australian Privacy Principles, you have the right to:
- Access the personal information we hold about you (APP 12);
- Correct personal information that is inaccurate, out-of-date, incomplete, irrelevant or misleading (APP 13);
- Request deletion or anonymisation of your information (subject to legal retention requirements above);
- Withdraw consent for any processing that is based on consent;
- Lodge a complaint with us first, and if not resolved, with the Office of the Australian Information Commissioner (OAIC): Website www.oaic.gov.au · Phone 1300 363 992.
To exercise these rights, contact us at rental@djaudio.au. We will respond within 30 days. There is no fee for making a request, although a reasonable fee may apply where compliance requires significant effort.
10Children and Minors
Our Equipment Rental service is not directed at children under 18. We require that all booking holders be at least 18 years of age, or have parental/guardian consent. We do not knowingly collect personal information from children under 18 outside of the parental/guardian booking context.
11Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The "Last Updated" date above reflects the most recent revision. Material changes will be communicated by posting a notice on djaudio.au and, where appropriate, by email to active customers.
