Cancellation Policy

Last Updated: 2026-06-03 Effective: 2026-06-03

THIRD KAGURA acknowledges the Traditional Owners of Country across Australia, and pays our respects to Elders past, present, and emerging.

This Cancellation Policy governs cancellation, rescheduling, and refunds for Equipment Rental bookings made with THIRD KAGURA Pty Ltd ("THIRD KAGURA", "we", "us", "our") through djaudio.au. It is read together with our Rental Terms and Conditions.

Your rights under the Australian Consumer Law are protected. Nothing in this Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
Two separate amounts — please read carefully. Your booking involves two distinct AUD amounts that are handled differently:
Company: THIRD KAGURA Pty Ltd (ABN 40 691 586 526) Governing law: New South Wales, Australia

01Scope and Booking Flow

This policy applies to:

It does not apply to event-organisation services or DJ booking services (covered by separate booking terms on thirdkagura.com).

1.1 Booking Flow

  1. Quote — You submit an enquiry. We send a written quote covering rental fee, dates, equipment, delivery, and the AUD 200 security bond (per booking). No commitment yet.
  2. Payment (booking confirmation) — On acceptance, the rental fee is paid in full by bank transfer or credit card. The AUD 200 security bond is held at this point (typically as a pre-authorisation or separate charge). Your booking is confirmed once payment clears.
  3. Service — Equipment is delivered and collected on the agreed dates. The bond is released after on-time, undamaged return.

02How to Cancel

To cancel a booking, please contact us in writing as soon as possible:

The cancellation takes effect from the time we receive your written notice. The applicable fee tier is determined by the number of days between our receipt of the written notice and the agreed rental start date.

03Cancellation Fees (Client-initiated)

3.1 Cancellation Fee Tier

For bookings governed by the current Rental Terms, the following three-tier structure applies to the deposit (the advance portion of the rental fee — not the security bond), based on how many days before the rental start date we receive your written cancellation:

Cancellation by the Client
When you cancel (notice received before the rental start date)Fee retained from deposit
8 or more days before0% — full refund of deposit (subject to any payment-processing fees)
2–7 days before50% of deposit forfeited (50% refundable)
The day before, the day of, or no-show100% of deposit forfeited (no refund)

These fees reflect THIRD KAGURA's legitimate interest in recovering losses where DJ, audio, and lighting equipment cannot reasonably be re-let at short notice, and are a genuine pre-estimate of that loss rather than a penalty. Where equipment is non-standard, custom-sourced, or carries non-recoverable third-party costs, different cancellation conditions may apply and will be confirmed in writing before contract finalisation.

04Force Majeure

4.1 Client-side Force Majeure

If your event cannot proceed due to circumstances beyond your reasonable control — such as severe weather, government restrictions, public transport disruption, accident, or illness — we will use reasonable efforts to reschedule your booking to a mutually acceptable date within 6 months, subject to equipment availability. Where rescheduling is not feasible, the standard cancellation fees in §3 apply. We may, at our discretion, reduce or waive fees where there is clear evidence of force majeure (e.g., a government order). Refunds in these cases are at our discretion and are not guaranteed.

4.2 Provider-side Force Majeure

If THIRD KAGURA is prevented from delivering the booked equipment due to circumstances beyond our reasonable control — such as equipment failure not detected until the day of delivery, supplier failure, our staff illness preventing delivery, or natural disaster affecting our premises — we will:

  1. Notify you as soon as practicable;
  2. Offer a substitute of equal or greater specification where possible;
  3. If no substitute is available or acceptable, refund all payments made for the affected booking (including the security bond).

This sub-clause is in addition to, and does not limit, your rights under the Australian Consumer Law consumer guarantees (e.g., the guarantee that services will be provided with due care and skill).

05Cancellation by THIRD KAGURA

Other than the force majeure circumstances in §4.2, we may cancel a booking where:

If we cancel for a reason other than your breach or fraud, we will refund all payments made for the affected booking. We are not liable for indirect costs (venue, marketing, third parties) except to the extent required by the Australian Consumer Law.

06Refund Timing and Method

Where a refund is due:

07Security Bond

The security bond is held separately from the rental fee and is governed by §5 of the Rental Terms. In summary:

The bond is independent of the cancellation fees in §3 above. If you cancel before the equipment is released, the bond is fully refundable.

08Disputes and Australian Consumer Law

If you are unhappy with how we have handled your cancellation, we encourage you to contact us first at rental@djaudio.au so we can attempt to resolve the matter directly. If the matter is not resolved, you have the right to seek external resolution through:

Nothing in this Policy excludes, restricts, or modifies your rights under the Australian Consumer Law that cannot lawfully be excluded.

09Contact and Governing Law

Cancellation enquiries and notices:

This Cancellation Policy is governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales, subject to your rights under the Australian Consumer Law.
