Cancellation Policy
THIRD KAGURA acknowledges the Traditional Owners of Country across Australia, and pays our respects to Elders past, present, and emerging.
This Cancellation Policy governs cancellation, rescheduling, and refunds for Equipment Rental bookings made with THIRD KAGURA Pty Ltd ("THIRD KAGURA", "we", "us", "our") through djaudio.au. It is read together with our Rental Terms and Conditions.
- City Area Delivery & Setup — AUD 200 per booking, including standard delivery, setup, and pickup within Sydney City. Outside Sydney City is quoted separately.
- Security Bond — AUD 200 per booking (typically held from the time of booking confirmation). Refunded in full when equipment is returned on time and in acceptable condition. Not affected by cancellation — if you cancel before equipment is released, the bond is refunded in full. See §7.
- Cancellation Fee — up to a stated percentage of the rental fee paid, limited to our reasonable loss and non-recoverable committed costs. This is not the security bond. See §3.
01Scope and Booking Flow
This policy applies to:
- Bookings for Equipment Rental (DJ, audio, lighting, AV, and related equipment) placed through djaudio.au or by direct enquiry to rental@djaudio.au;
- Cancellations initiated by the Client;
- Cancellations or non-performance by THIRD KAGURA;
- Force majeure events affecting either party.
Event-organiser, DJ, photography, or other services are covered only where they are included in the accepted written quote. Any separate provider terms apply only if disclosed before payment.
1.1 Booking Flow
- Quote — You submit an enquiry. We send a written quote covering the rental fee, dates, equipment, any services, the applicable delivery charge, and the AUD 200 security bond. No booking is made by submitting the form.
- Acceptance and booking confirmation — We provide the payment and identity-verification requirements directly. Your booking is confirmed only after written acceptance and completion of the requirements stated in the quote.
- Service — Equipment is delivered and collected on the agreed dates. The bond is released after on-time, undamaged return.
02How to Cancel
To cancel a booking, please contact us in writing as soon as possible:
- Email: rental@djaudio.au
- Subject line: "Cancellation — [your booking reference or rental start date]"
- Please include: your name, booking reference (if any), rental start date, and reason (optional but helpful).
The cancellation takes effect from the time we receive your written notice. The applicable fee tier is determined by the number of days between our receipt of the written notice and the agreed rental start date.
03Cancellation Fees (Client-initiated)
3.1 Cancellation Fee Tier
The following maximum cancellation fees apply to the rental fee paid, based on how many days before the rental start date we receive your written cancellation. The security bond is separate and is refunded in full if equipment has not been released.

We will not retain more than the reasonable loss caused by the cancellation, including equipment held unavailable for other customers, work already performed, and non-recoverable third-party costs. If that amount is lower than the maximum above, we refund the difference. We will explain the calculation on request. Any different conditions for custom-sourced equipment or third-party services will be disclosed and agreed in writing before payment.
04Force Majeure
4.1 Client-side Force Majeure
If your event cannot proceed due to circumstances beyond your reasonable control — such as severe weather, government restrictions, public transport disruption, accident, or illness — we will first use reasonable efforts to reschedule your booking to a mutually acceptable date within 6 months, subject to equipment availability. If rescheduling is not feasible, §3 applies, including its limit to reasonable loss and non-recoverable committed costs. We will consider evidence of the circumstances when calculating any fee.
4.2 Provider-side Force Majeure
If THIRD KAGURA is prevented from delivering the booked equipment by circumstances genuinely beyond our reasonable control — such as a natural disaster, government restriction, or major transport shutdown — we will:
- Notify you as soon as practicable;
- Offer a substitute of equal or greater specification where possible;
- If no substitute is available or acceptable, refund all payments made for the affected booking (including the security bond).
This sub-clause is in addition to, and does not limit, your rights under the Australian Consumer Law consumer guarantees (e.g., the guarantee that services will be provided with due care and skill).
05Cancellation by THIRD KAGURA
Other than the force majeure circumstances in §4.2, we may cancel a booking where:
- Payment or required bond has not been received within the agreed timeframe;
- The booking is in breach of our Rental Terms (e.g., unsafe access conditions disclosed late);
- We have reasonable grounds to believe the booking is fraudulent.
Where it is safe and practical, we will give notice and an opportunity to address a breach before cancelling. If we cancel for a reason other than your breach or fraud, we will refund all payments made for the affected booking. Any deduction following your breach is limited to services already supplied and our reasonable loss. Nothing here limits a remedy available under the Australian Consumer Law.
06Refund Timing and Method
Where a refund is due:
- We will process the refund within 10 business days of confirmation that the refund is payable;
- Refunds are made by the original payment method where possible (bank transfer, credit card reversal);
- We do not deduct a general administration fee. Any actual non-recoverable third-party charge deducted from a change-of-mind cancellation refund must have been disclosed before payment and will be identified in the refund calculation;
- Bank processing times may add 3–5 additional business days, depending on the issuing bank.
07Security Bond
The security bond is held separately from the rental fee and is governed by §5 of the Rental Terms. In summary:
- A bond of AUD 200 per booking may be required before equipment release;
- The bond is released after the equipment is returned on time and in acceptable condition;
- Deductions from the bond may be made for loss, damage, late return, or cleaning fees (see Rental Terms §7–8);
- The bond is refunded subject to bank processing times (typically 3–10 business days from release authorisation).
The bond is independent of the cancellation fees in §3 above. If you cancel before the equipment is released, the bond is fully refundable.
08Disputes and Australian Consumer Law
If you are unhappy with how we have handled your cancellation, we encourage you to contact us first at rental@djaudio.au so we can attempt to resolve the matter directly. If the matter is not resolved, you have the right to seek external resolution through:

This Cancellation Policy is governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales, subject to any rights you have to bring a claim elsewhere.
